Healthera provides the software platform that supports certain online features, while Evercare Pharmacy remains responsible for the pharmacy and healthcare services provided by Evercare.

When you use functionality provided through the Healthera platform, additional Healthera terms or policies may also apply.

3. Using our website

You may use the Evercare Pharmacy website for lawful personal purposes, including to:

  • find information about our pharmacies
  • view pharmacy and healthcare services
  • request or book appointments
  • access prescription services
  • contact one of our pharmacies
  • access health information
  • use online services provided through the Healthera platform

You must not use the website in any way that is unlawful, fraudulent or harmful.

You must also not knowingly introduce viruses, malicious software or other technology that could damage or interfere with the website or its supporting systems.

4. Online pharmacy services

Services displayed on the website may include NHS and private pharmacy services.

Availability may depend on:

  • the pharmacy location
  • your age
  • clinical eligibility
  • NHS eligibility
  • availability of a pharmacist or prescriber
  • appointment availability
  • the outcome of a clinical assessment

Displaying a service on the website does not guarantee that the service or treatment will be appropriate or available to you.

5. Clinical assessments

Some pharmacy services require an assessment by a pharmacist, prescriber or other suitably qualified healthcare professional.

Where an assessment is required, any treatment or supply is subject to the healthcare professional determining that it is safe and clinically appropriate.

Completing an online questionnaire, making a booking or paying for a consultation does not guarantee that a particular treatment or medicine will be supplied.

Healthcare professionals may decide that:

  • no treatment is required
  • a particular treatment is unsuitable
  • additional information is required
  • you should contact your GP
  • you should use another healthcare service
  • urgent medical assessment is necessary

Clinical decisions are made independently by the relevant healthcare professional.

6. Prescription medicines

Prescription-only medicines are only supplied where legally permitted and following an appropriate clinical assessment.

You should provide complete and accurate information when completing any consultation or health questionnaire.

You must not deliberately provide false or misleading information about your:

  • identity
  • age
  • medical history
  • symptoms
  • medication
  • allergies
  • health conditions
  • weight or other clinical measurements
  • other information relevant to your treatment

Providing inaccurate information may affect the safety or suitability of any healthcare advice or treatment.

7. NHS services

Some services provided by Evercare Pharmacy are funded by the NHS.

Eligibility for NHS services depends on the rules applicable to the relevant service.

Where an NHS service is described as free, this refers to the consultation or service where the patient meets the applicable NHS eligibility criteria.

Normal NHS prescription charges may still apply where relevant unless you are exempt.

8. Private services

Some Evercare services are provided privately.

Where charges apply, the price will normally be displayed before you book or purchase the service.

In some circumstances, a final price may depend on:

  • the consultation
  • treatment required
  • medicines supplied
  • vaccines required
  • additional testing
  • follow-up treatment

Where this applies, we will explain the relevant costs before treatment is supplied.

9. Bookings

Appointments may be booked through the Evercare website, the Healthera platform or another approved booking system.

When making a booking, you must provide accurate information.

Appointment availability may change and we may occasionally need to:

  • change the appointment time
  • change the healthcare professional
  • move the appointment to another suitable time
  • cancel an appointment

Where practical, we will contact you using the details you provided.

10. Prescriptions

Online prescription functionality may be provided through the Healthera platform.

Depending on the service, you may be able to:

  • nominate Evercare Pharmacy
  • request repeat prescriptions
  • receive prescription-related notifications
  • communicate with the pharmacy
  • manage prescription requests

Submitting a prescription request does not itself mean that a prescription has been issued by your GP or received by the pharmacy.

Prescription requests remain subject to the relevant GP practice, NHS systems and pharmacy processes.

11. Payments

Some private pharmacy services or products may require payment online.

Where online payments are available, they may be processed through third-party payment providers integrated with the Healthera platform.

Healthera’s pharmacy platform uses Stripe Connect for certain payment functionality. Pasted text

Evercare does not normally receive your complete payment-card details where payments are processed directly by an authorised payment provider.

Additional terms from the relevant payment provider may apply.

12. Cancellations and refunds

Cancellation and refund rights depend on the service or product purchased.

Where you have booked an appointment, please contact the relevant Evercare branch as soon as possible if you are unable to attend.

Refunds may not be available where:

  • a consultation has already taken place
  • a healthcare professional has already provided the service
  • personalised or clinical work has already been completed
  • a medicine or healthcare product cannot legally or safely be returned
  • the service is otherwise exempt from cancellation rights

Any statutory rights you have as a consumer are unaffected.

13. Medicines and products

Where medicines or healthcare products are supplied, you should:

  • read the packaging and patient information leaflet
  • follow the instructions supplied with the product
  • follow the advice provided by the pharmacist or prescriber
  • contact the pharmacy if you have questions about how to use the product

If you experience a serious or unexpected reaction, seek appropriate medical assistance.

14. Delivery

Where prescription or product delivery is available, availability may depend on the relevant branch and delivery area.

Delivery times are estimates unless we expressly state otherwise.

Delays may occur because of circumstances such as:

  • prescription availability
  • GP approval
  • medicine availability
  • traffic
  • weather
  • courier delays
  • incorrect delivery information
  • circumstances outside our reasonable control

The original Healthera agreement also makes clear that delivery services may be provided through the Healthera platform and can involve patient-paid delivery functionality. Pasted text

15. Your responsibilities

When using our website and online services, you agree to:

  • provide accurate information
  • keep your contact information up to date
  • protect your login credentials
  • not allow another person to use your account without permission
  • comply with instructions provided by pharmacy staff
  • use the services lawfully

If you believe someone has gained unauthorised access to your account, you should contact the relevant service provider promptly.

16. Website accounts and Healthera accounts

Certain services may require a Healthera account or another online account.

You are responsible for keeping your login credentials secure.

Healthera may apply its own terms to the operation of your Healthera account.

Where there is an issue specifically relating to the operation of Healthera’s software, account or application, you may be directed to Healthera support.

17. Health information on our website

Health information published on our website is intended to provide general information and does not replace an individual assessment by a healthcare professional.

Where appropriate, clinical content may be reviewed by a pharmacist or other healthcare professional.

However, you should not rely solely on website content to diagnose or treat a medical condition.

If you are concerned about your health, contact an appropriate healthcare professional.

In an emergency, call 999.

18. Third-party websites

Our website may contain links to other websites and services, including:

  • NHS services
  • Healthera
  • Google
  • healthcare information providers
  • payment providers
  • booking platforms

These websites are operated by third parties and their own terms and privacy policies apply.

We are not responsible for the content or availability of third-party websites.

This follows the same general position in Healthera’s original terms, which state that third-party websites are used at the user/customer’s own risk and are governed by the third party’s own terms. Pasted text

19. Intellectual property

Unless otherwise stated, the website content, branding, design, text, graphics and other materials are owned by Evercare Pharmacy, Healthera or the relevant licensors.

You may use website content for your own personal, non-commercial purposes.

You must not, without permission:

  • copy substantial portions of the website
  • reproduce website content commercially
  • modify or redistribute proprietary content
  • attempt to copy or reverse engineer software used by the website

Healthera retains ownership of the intellectual property associated with its software and platform. Pasted text

20. Availability of the website

We aim to keep the website and online services available, but we cannot guarantee uninterrupted access.

Services may occasionally be unavailable because of:

  • maintenance
  • technical problems
  • system updates
  • internet or telecommunications failures
  • third-party platform outages
  • circumstances outside our reasonable control

Healthera similarly does not guarantee that its SaaS platform will always be uninterrupted or error-free. Pasted text

21. Privacy and personal information

Your personal information will be handled in accordance with our Privacy Policy.

Because Evercare uses the Healthera platform, Healthera may also process certain information when you use online services.

Please review:

  • Evercare Pharmacy Privacy Policy
  • Evercare Pharmacy Cookies Policy
  • Healthera Privacy Policy where applicable

The underlying Healthera agreement recognises that both Healthera and the pharmacy may have data-controller responsibilities depending on the information and processing involved. Pasted text

22. Limitation of liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:

  • death or personal injury caused by negligence
  • fraud or fraudulent misrepresentation
  • any other liability which cannot legally be excluded

Subject to applicable law, we are not responsible for loss caused by:

  • your misuse of the website
  • inaccurate information you provide
  • failure of third-party websites or systems
  • internet or communications failures outside our control
  • circumstances that could not reasonably have been prevented

Nothing in these Terms affects your statutory consumer rights.

23. Changes to the website

We may change:

  • website content
  • available services
  • prices
  • booking functionality
  • opening hours
  • website features

from time to time.

Where appropriate, significant changes will be reflected on the website.

24. Changes to these Terms

We may update these Terms from time to time.

The latest version will always be published on this page together with the date it was last updated.

25. Complaints

If you have a complaint about a pharmacy service, please contact Evercare Pharmacy so that we can investigate the matter.

Information about our complaints procedure and pharmacy regulatory details can be found on our Regulation and Complaints page.

If your complaint relates specifically to Healthera’s software or platform, we may refer the technical aspect of the issue to Healthera.

26. Governing law

These Terms are governed by the laws of England and Wales.

Any dispute relating to these Terms will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory rights available to consumers.
